1. INTRODUCTION

This Privacy Policy describes how NODAL LOGICS LLC, a Wyoming limited liability company doing business as SafeNY (“SafeNY,” “Company,” “we,” “us,” or “our”), collects, uses, stores, discloses, and protects information obtained through the SafeNY platform, websites, landing pages, applications, communications systems, and related services (collectively, the “Platform”).

This Privacy Policy applies to information collected from users, prospective users, consumers, visitors, attorneys, law firms, business representatives, and other individuals who interact with the Platform or communicate with SafeNY.

SafeNY operates a technology platform and legal advertising network that publishes information derived from publicly available transportation and motor-carrier safety records and facilitates consumer inquiries that may be transmitted to participating attorneys, law firms, and legal-service providers.

This Privacy Policy applies to information collected through the Platform, through communications with SafeNY, through inquiry submissions, through participation in SafeNY services, and through other interactions with SafeNY.

2. INFORMATION WE COLLECT

We may collect information directly from users, automatically through use of the Platform, from governmental data sources, from service providers, and from other lawful sources.

Information collected may include:

(c) telephone number;

(d) city and state of residence;

(e) incident information;

(f) accident information;

(g) inquiry details and narrative descriptions;

(h) communications submitted through forms;

(i) records of communications with SafeNY;

Federal Motor Carrier Safety Administration (FMCSA);

SAFER databases;

governmental agencies;

public records;

regulatory databases; and

other lawful third-party sources.

Such information may be subject to the terms, conditions, policies, limitations, and disclosures applicable to the original source, and SafeNY does not control the content, availability, accuracy, completeness, or continued publication of such information.

4. HOW WE USE INFORMATION

We may use information collected through the Platform for purposes including:

(a) operating the Platform;

(b) processing inquiries;

(c) routing inquiries to participating attorneys, law firms, and legal-service providers;

(d) facilitating communications;

(e) maintaining consumer records;

(f) lead-generation operations;

(g) advertising and marketing activities;

(h) analytics and business intelligence;

(h-1) improving, developing, testing, monitoring, and enhancing the Platform and related services;

(i) fraud prevention;

(j) identity verification;

(k) record retention;

(l) compliance activities;

(m) legal and regulatory obligations;

(m-1) documenting, maintaining, and verifying consumer consent and communication authorizations;

(n) customer support;

(o) platform administration;

(p) enforcing our agreements;

(p-1) establishing, exercising, defending, investigating, or resolving legal claims, disputes, investigations, or regulatory matters; and

(q) protecting our rights, users, attorneys, service providers, and business operations.

5. DISCLOSURE OF INFORMATION

(a) participating attorneys;

(b) participating law firms;

(c) legal-service providers;

(d) advertising partners;

(e) technology vendors;

(f) cloud-service providers;

(g) customer-support providers;

(h) analytics providers;

(i) consent-verification providers;

(j) TrustedForm and similar compliance vendors;

(k) affiliated entities;

(l) professional advisors;

(m) insurers;

(m-1) payment processors, hosting providers, telecommunications providers, and other service providers that support operation of the Platform;

(n) courts, regulators, and governmental authorities;

(n-1) parties involved in investigations, litigation, dispute resolution proceedings, subpoena responses, or legal compliance matters;

(o) purchasers in connection with a merger, acquisition, financing, or asset sale; and

(p) other parties where disclosure is authorized by law or user consent.

We may also disclose information where reasonably necessary to protect the safety, rights, property, business operations, users, attorneys, service providers, or legal interests of SafeNY or others.

6. LEAD DELIVERY AND ATTORNEY DISCLOSURES

When you submit an inquiry through the Platform, information you provide may be transmitted to one or more participating attorneys, law firms, or legal-service providers for evaluation and potential response. Such information may include contact information, inquiry details, incident information, communication records, consent records, and other information submitted through the Platform.

Once information is transmitted to a participating attorney, law firm, or legal-service provider, that recipient may maintain, process, store, disclose, or otherwise use such information in accordance with its own privacy practices and legal obligations. SafeNY does not control and is not responsible for the privacy practices, data-security practices, retention practices, communications, disclosures, or other activities of participating attorneys, law firms, or legal-service providers after information has been transmitted.

7. COMMUNICATIONS

By submitting information through the Platform, you authorize communications relating to your inquiry, including communications from SafeNY and participating attorneys, law firms, legal-service providers, contractors, and authorized representatives.

Communications may occur by:

(a) telephone;

(b) email;

(c) text message;

(d) prerecorded message, where permitted by law; or

(e) other lawful communication methods.

To the extent permitted by applicable law, such communications may be initiated using automated technologies, automated dialing systems, artificial voice technologies, prerecorded messages, email systems, text messaging systems, or other communication technologies.

Records relating to communications, consent, and communication preferences may be maintained by SafeNY. SafeNY may also maintain records relating to communication history, communication delivery, consent verification, submission metadata, and related audit-trail information.

8. COOKIES AND TRACKING TECHNOLOGIES

The Platform may use cookies, pixels, tags, scripts, analytics technologies, session identifiers, and similar technologies to:

(a) operate the Platform;

(b) remember user preferences;

(c) measure performance;

(d) analyze user behavior;

(e) improve functionality;

(e-1) maintain security and integrity of the Platform;

(f) detect fraud; and

(g) support advertising and marketing activities.

Certain cookies, analytics technologies, and similar tools may be provided by third-party service providers that assist SafeNY with analytics, security, functionality, advertising, communications, or Platform operations.

Users may be able to modify browser settings to limit certain tracking technologies, although doing so may affect Platform functionality. Certain portions of the Platform may not function properly if cookies or similar technologies are disabled.

9. DATA RETENTION

SafeNY may retain information for as long as reasonably necessary to:

(a) operate the Platform;

(b) maintain records;

(c) document consumer consent;

(d) support legal compliance;

(e) resolve disputes;

(f) enforce agreements;

(g) defend legal claims;

(h) satisfy business and operational requirement; and

(i) maintain consent records, communication records, audit-trail information, submission metadata, and related documentation for evidentiary, compliance, dispute-resolution, and risk-management purposes.

Retention periods may vary based upon the nature of the information and applicable legal obligations. SafeNY may retain information for longer periods where reasonably necessary to comply with legal obligations, respond to governmental requests, preserve evidence, resolve disputes, enforce agreements, protect business interests, or defend against actual or potential claims.

10. DATA SECURITY

SafeNY maintains commercially reasonable administrative, technical, physical, and organizational safeguards designed to protect information against unauthorized access, disclosure, alteration, loss, destruction, or misuse.

No security system can guarantee absolute security. Users acknowledge that transmission of information over the internet involves inherent risks.

Accordingly, SafeNY cannot and does not warrant or guarantee the security, confidentiality, availability, or integrity of any information transmitted to, from, or through the Platform.

11. CHILDREN'S PRIVACY

The Platform is not directed to children under eighteen (18) years of age.

SafeNY does not knowingly collect personal information from children under eighteen (18) years of age. If SafeNY becomes aware that personal information has been collected from a child under eighteen (18) years of age in a manner inconsistent with this Privacy Policy, SafeNY may take reasonable steps to delete such information, subject to applicable law and any legal, regulatory, evidentiary, or record-retention obligations.

12. DO NOT TRACK

The Platform may not respond to browser-based “Do Not Track” signals because no uniform industry standard currently governs such responses. Users may be able to manage certain tracking preferences through browser settings or device controls.

Depending upon applicable law and jurisdiction, users may possess rights relating to:

(a) access;

(b) correction;

(c) deletion;

(d) portability;

(e) restriction of processing;

SafeNY reserves the right to verify identity before responding to any request. SafeNY may decline, limit, condition, or deny any request to the extent permitted by applicable law, including where SafeNY is unable to verify identity, where the request is manifestly unfounded, excessive, repetitive, technically infeasible, would adversely affect the rights of others, would interfere with legal obligations, would compromise security measures, or where retention of information is required for legal, regulatory, evidentiary, contractual, fraud-prevention, dispute-resolution, or business purposes. SafeNY may request additional information reasonably necessary to verify the identity, authority, or legal entitlement of the individual submitting a request.

The availability, scope, and exercise of any privacy right may vary depending upon applicable law, jurisdiction, residency, the nature of the information involved, and SafeNY’s legal and operational obligations.

14. THIRD-PARTY WEBSITES

The Platform may contain links to third-party websites, services, advertisements, or resources.

SafeNY is not responsible for the privacy practices, content, security, or operations of third-party websites or services.

Users access third-party websites, services, advertisements, and resources at their own risk and should review the applicable privacy policies, terms of use, and other governing documents of such third parties before providing information or engaging in any transaction.

15. BUSINESS TRANSFERS

Information collected through the Platform may be transferred, assigned, disclosed, or otherwise conveyed in connection with a merger, acquisition, financing transaction, restructuring, bankruptcy proceeding, asset sale, or other business transaction. Such information may be transferred as part of the assets, business operations, contractual rights, goodwill, databases, records, or other interests involved in the applicable transaction.

16. INTERNATIONAL USERS

The Platform is operated from the United States.

By using the Platform, users understand and acknowledge that information may be processed, stored, and transferred within the United States and other jurisdictions where service providers operate.

17. CHANGES TO THIS PRIVACY POLICY

SafeNY may modify this Privacy Policy from time to time.

Updated versions will become effective upon posting unless otherwise stated. Users further acknowledge that privacy laws, data-protection laws, and regulatory requirements applicable in the United States or other jurisdictions may differ from those applicable in the user’s jurisdiction of residence.

Continued use of the Platform following publication of revised versions constitutes acknowledgment of the updated Privacy Policy.

Nothing contained in this Privacy Policy constitutes legal advice, establishes an attorney-client relationship, or modifies the SafeNY Terms of Service or any agreement between SafeNY and participating attorneys.

20. GOVERNING DOCUMENTS

This Privacy Policy should be read together with the SafeNY Terms of Service. In the event of a conflict between this Privacy Policy and applicable law, applicable law shall control to the extent required.
